Gabb Wireless Affiliate Program — Terms & Conditions
Welcome, and thank you for your interest in partnering with Gabb Wireless! Gabb makes safer, distraction-free phones and watches for kids.
These Terms & Conditions ("Terms") govern participation in the Gabb Wireless Affiliate Program (the "Program") and apply to all publishers, influencers, content creators, and other partners ("you," "affiliate," or "publisher") who refer customers to Gabb Wireless ("we," "us," "Gabb," or "advertiser"). By joining the Program, you agree to be bound by these Terms in full. If you do not agree, you are not authorized to participate in the Program.
We reserve the right to approve, reject, or remove any affiliate from the Program at our sole discretion.
1. Brand Terms & Search Marketing
To protect the integrity of our brand in paid search, publishers must follow these rules for any search engine marketing (SEM) campaign:
- You are not allowed to bid on any of our Protected Brand keywords - including but not limited to:
Gabb, Gabb Wireless, GabbWireless, Wireless Gabb, Gabb Life, Gabb Phone, Gabb Phones, Gabb Watch, Gabb Watches, GabbPhone, GabbWatch, and any misspelling, phonetic variant, or compound term combining "Gabb" with another word (for example, "Gabb Kids," "Gabb Family," "My Gabb," "Gabb App," or "Gabb 4 Pro"). - Negative matching: Required. Publishers must negative-match all protected keywords above, including misspellings and compound variations, in every SEM campaign. This includes exact, phrase and broad matching settings in most ad platforms like Google Ads.
- Non-compete keywords: Publishers may not outrank Gabb in paid search results for any of the protected keywords listed above.
- Recommended keywords — publishers are encouraged to bid on these instead:
Cell phone, cell phone for kids, wireless for kids, smartphone, smartphone for kids, wireless, smartphone for children, child-safe phone, phone, kids smartwatch, GPS watch for kids, safe phone for kids. - Display URLs and ad copy: Publishers may not use any protected keyword (including misspellings or compound variations) in the display URL or ad copy of an SEM campaign. Limited, advertiser-approved use of core brand terms (Gabb, Gabb Wireless, Gabb Phone, Gabb Watch) may be permitted on a case-by-case basis, but requires prior approval.
- Direct linking: Publishers may not use a display URL that links directly to the Gabb website while referencing Gabb's brand terms. No direct linking from any ad platform is permitted without prior written approval.
2. Website & Content Standards
Publisher websites, apps, and other properties must not use, in their domain, URL, content, or metadata, any of the following: adult content, pornography, gambling, CBD, sexual content, or explicit language. Sites containing this type of content will not be accepted into, or will be removed from, the Program.
3. Coupon & Promotional Code Policy
Coupon and promo codes are sometimes used by qualifying affiliates, so please read this section carefully:
- Publishers may only use coupon and promotional codes that have been specifically assigned to them through the affiliate program.
- Orders that come through using a coupon or promo code not assigned to that publisher will not receive credit, and any resulting commission will be forfeited.
- Publishers may not create, distribute, or promote their own unauthorized codes, nor promote another publisher's assigned code.
- This policy applies across every promotional channel, including but not limited to those described in Section 4 below (incentivized traffic, email, software/toolbars, sub-affiliates, and social media).
4. Approved Promotional Methods
The following promotional methods are permitted, subject to the coupon/code policy in Section 3:
- Incentivized traffic (cashback, points, miles, or other compensation for a completed purchase) — Allowed, using only codes assigned to the publisher.
- Email marketing — Allowed, using only codes assigned to the publisher.
- Sub-affiliates (a network of independently owned sites operating collectively under one publisher) — Allowed. Both the publisher and any sub-affiliates may only use codes assigned to that publisher. If you run a sub-affiliate network, you will be responsible for your sub-affiliates adhering to the same terms and conditions found herein and the same punishments will be applied to you for any violations of our terms and conditions.
- Social media — Allowed, using only codes assigned to the publisher.
-
Software, browser extensions, and toolbars — Allowed, subject to the following additional conditions:
- Publishers using software, browser extensions, toolbars, or similar applications (including desktop or mobile apps that generate alerts, popups, or automatic redirects) must be able to demonstrate that the end user has knowingly and affirmatively consented to install and run that software on their device. Consent must be clear and verifiable — bundled installs, pre-checked opt-ins, or consent buried in unrelated terms are not acceptable.
- Because Gabb commissions are awarded according to the specific attribution standards defined by the affiliate platform, software publishers must check whether the end user's device already carries an active, unexpired tracking cookie or click reference from another affiliate, or any other tracking identifier before applying their own.
- If a valid prior affiliate tracking cookie or code is already present, the software or toolbar may not override, replace, or take priority over that existing attribution. The original affiliate's tracking must be left intact and credited for the resulting sale.
- Violation of the consent or cookie-priority requirements above may result in commission reversal and/or removal from the Program.
5. Commissions & Payment
Commissions are calculated based on the order subtotal at the time of purchase, excluding taxes, shipping, and other fees. The following are not commissionable:
- Gift cards and gift wrapping
- Sales generated through unauthorized or unassigned coupon/promo codes (see Section 3)
- Orders that result in a return, chargeback or refund
- Fraudulent orders (e.g.: unauthorized use of a customer's credit card, etc.)
Commission payments are only made for successfully completed, non-reversed transactions.
6. Program Term Updates
When applying to Gabb's affiliate program, you will be automatically enrolled in our default program terms. Other custom terms are available to qualifying affiliates.
Because most affiliate platforms don't allow a live, active term set to be edited in place once publishers are enrolled under it, updates are handled as follows:
- A new version of the relevant term set is created from the existing one, with the necessary changes applied.
- The new version is reviewed and approved internally before publication.
- Publishers are transitioned to the new version per the platform's standard notification or re-enrollment process; publishers remain under their previously agreed terms until that transition occurs.
- Prior versions are retained for recordkeeping and audit purposes but are no longer active once publishers have moved to the current version.
This process applies regardless of which affiliate network or platform hosts the Program. Ultimately, affiliates are responsible for ensuring that they are enrolled and active in the current default affiliate program terms.
7. Violations & Enforcement
We take compliance with these Terms seriously. If a publisher is found to have violated any part of these Terms:
- Gabb will issue either a warning or immediate expulsion from the Program, at our discretion depending on the severity of the violation.
- Any publisher expelled from the Program will forfeit all commissions earned during the current calendar month. If the violation is found to involve criminal conduct, Gabb reserves the right to also revoke commissions from prior months and seek further legal remedies.
- Only one warning will ever be issued to a given publisher. If a second violation occurs after a warning has been given, the publisher will be subject to immediate and indefinite expulsion from the Program, with no further warning.
8. Removal from the Program
If you'd like to leave the Program at any time, please contact your affiliate program manager. Gabb also reserves the right to remove any publisher from the Program at its discretion, consistent with Section 7 above.
Thank you for helping us bring safer technology to families. If you have any questions about these Terms, please reach out to your Gabb affiliate program contact.
